SAFETY WARNINGS & TERMS OF SALE

All Products — Issue 2025

These Safety Warnings and Terms of Sale apply to all products supplied by Tracksonhire Ltd (trading as Affordable Generators), including single phase and three phase diesel generators, automatic transfer switches (ATS), manual changeover switches, isolation transformers, and all associated accessories, components, and spare parts. By placing an order, accepting delivery, or operating any product supplied by Tracksonhire Ltd, the buyer confirms unconditional acceptance of all terms set out in this document.


SECTION 1 — CRITICAL SAFETY WARNINGS

⚠ CARBON MONOXIDE — RISK OF DEATH

DO NOT operate any generator indoors, in any enclosed, partially enclosed, basement, garage, outbuilding, tent, welfare unit, or poorly ventilated space under any circumstances. Diesel engines produce carbon monoxide (CO) — a colourless, odourless, tasteless gas that is fatal. Exposure to high concentrations causes loss of consciousness and death within minutes without warning. CO cannot be detected by human senses. The buyer is solely responsible for ensuring adequate permanent ventilation and safe exhaust dispersal at all times.

⚠ MAINS ISOLATION — RISK OF ELECTROCUTION AND DEATH

DO NOT connect any generator, ATS unit, or changeover switch to a mains supply without a certified Automatic Transfer Switch (ATS) or manual changeover switch installed by a qualified electrician. Connecting a generator to mains without proper isolation is illegal under the Electricity at Work Regulations 1989, will back-feed electrical energy onto the distribution network, and can electrocute utility workers, emergency services personnel, and members of the public working on what they believe to be a de-energised circuit. This applies regardless of generator size, output, or application. There are no exceptions.

⚠ EARTHING — RISK OF ELECTROCUTION

DO NOT operate any generator, ATS unit, or isolation transformer without correct earthing in place. All products must be earthed in accordance with BS 7671 (18th Edition IET Wiring Regulations) before first use. Earthing must be assessed, designed, and installed by a qualified electrician. Operating without correct earthing creates a risk of electric shock, electrocution, equipment destruction, and fire. The buyer bears sole and exclusive responsibility for all earthing arrangements.

⚠ OVERLOADING — RISK OF FIRE AND EQUIPMENT DESTRUCTION

DO NOT connect loads that exceed the generator's rated prime power output. The buyer is solely responsible for carrying out correct load calculations, accounting for starting surge currents of motors and compressors (which can be 3–7x running current), phase balancing on three-phase installations, power factor correction where required, and correct cable sizing and protection. Overloading causes overheating, insulation failure, alternator damage, and fire. These consequences are not covered under warranty and liability rests entirely with the buyer.

⚠ INSTALLATION — QUALIFIED PERSONS ONLY

All generators, ATS units, changeover switches, isolation transformers, and associated electrical equipment must be installed, commissioned, and maintained exclusively by suitably qualified and competent persons holding appropriate qualifications (e.g. 18th Edition BS 7671, ECS card, or equivalent). Installation by unqualified persons is illegal under the Electricity at Work Regulations 1989, voids all warranty, and transfers full liability for any resulting damage, injury, or death to the buyer. Affordable Generators accepts no liability whatsoever arising from non-compliant installation.

⚠ SAFETY FEATURES — BUYER AND INSTALLER RESPONSIBILITY

The installation of all safety features — including circuit breakers, residual current devices (RCDs), ground fault circuit interrupters (GFCIs), surge protectors, and all other protective devices — is the sole responsibility of the buyer or their designated installer. These features are essential for safe operation and must comply with BS 7671 and all applicable safety standards. Generators are supplied without end-use protective devices fitted. The buyer or their qualified electrician must specify, source, and install all necessary protection before the generator is energised. Where a three-phase generator is to be used in a single-phase application, it must be adapted with appropriate phase conversion equipment and safety devices by a qualified electrician before use. Operating any generator without correct protective devices in place is at the buyer's sole risk.

⚠ FUEL — FIRE, EXPLOSION, AND LEGAL RISK

Use diesel fuel only in all diesel generator products. Never use petrol, kerosene, or any alternative fuel. Red diesel (rebated fuel) is illegal for use in road vehicles and on construction sites since April 2022 under HMRC regulations — fines and vehicle seizure can result. Store and handle diesel fuel in accordance with DSEAR 2002 and the Petroleum (Consolidation) Regulations 2014. Never refuel while the engine is running or hot. Fuel spills must be cleaned up immediately in accordance with environmental regulations. The buyer is solely responsible for correct fuel selection, legal compliance, and safe fuel storage at all times.

⚠ EXHAUST AND VENTILATION

Exhaust gases must be directed away from all occupied areas, air intakes, windows, doors, ventilation grilles, and public spaces. The buyer is solely responsible for specifying, installing, and maintaining appropriate exhaust routing, extensions, rain caps, and silencers required to achieve safe and lawful exhaust dispersal. Exhaust system modifications or extensions not supplied by Affordable Generators are the buyer's sole responsibility.

⚠ ATS AND CHANGEOVER SWITCHES — SPECIFIC RISKS

ATS units and manual changeover switches involve simultaneous interaction with both generator output and live mains supply. Incorrect installation, incorrect rating, voltage mismatch, or failure to follow the manufacturer's wiring diagram can cause electrocution, equipment destruction, fire, and back-feeding of the mains network. The buyer is solely responsible for confirming correct voltage, frequency, current rating, and phase compatibility between the ATS unit and both the generator and mains supply before installation. All ATS and changeover switch installation must be carried out by a qualified electrician.

⚠ ISOLATION TRANSFORMERS — SPECIFIC RISKS

Isolation transformers must be correctly specified for the intended application. The buyer is solely responsible for confirming input voltage, output voltage, kVA rating, frequency, insulation class, and IP rating suitability prior to purchase. Incorrect specification, overloading, or incorrect installation of an isolation transformer can cause electric shock, fire, equipment damage, and death. Isolation transformers do not eliminate all electrical hazards — the secondary circuit remains live and dangerous. PAT testing and periodic inspection of isolation transformers is the buyer's sole responsibility.

⚠ NOISE AND EMISSIONS — LEGAL COMPLIANCE

Generator operation produces noise and exhaust emissions. The buyer is solely responsible for ensuring operation complies with the Environmental Protection Act 1990, local authority noise regulations, planning conditions, statutory nuisance legislation, and any site-specific environmental permits. Affordable Generators accepts no liability for enforcement action, fines, abatement notices, or legal proceedings arising from non-compliant generator operation.

⚠ FIRE RISK — SITING AND CLEARANCES

Generators must be sited on a stable, level, non-combustible surface with adequate clearance from flammable materials, structures, vegetation, and stored goods in accordance with the operator manual. The buyer is solely responsible for assessing fire risk, maintaining adequate clearances, providing appropriate fire suppression equipment, and complying with the Regulatory Reform (Fire Safety) Order 2005 and all applicable fire safety legislation.

⚠ WEIGHT AND STRUCTURAL LOADING

Generator sets, particularly canopied units, are extremely heavy. The buyer is solely responsible for ensuring that the installation surface, floor, platform, trailer, or structure is capable of supporting the full operational weight of the unit including fuel load. Structural assessments must be carried out by a suitably qualified structural engineer where required. Affordable Generators accepts no liability for structural failure, collapse, or consequential damage.


SECTION 2 — TERMS OF SALE

2.1 Parties and Application of Terms

These terms are between Tracksonhire Ltd (company registered in England and Wales), trading as Affordable Generators ("the Seller"), and the person, company, sole trader, partnership, or other entity placing an order ("the Buyer"). These terms apply to all orders, whether placed by telephone, WhatsApp, email, online, or in person. These terms supersede all prior representations, negotiations, and agreements, whether oral or written, and constitute the entire agreement between the parties in relation to the goods supplied. No variation to these terms shall be effective unless agreed in writing and signed by a director of Tracksonhire Ltd.

These terms are intended for business-to-business transactions only. By placing an order the Buyer confirms they are purchasing in the course of a business and not as a consumer. Where the Buyer is a sole trader or individual, they confirm that the goods are being purchased for business purposes.

2.2 Orders and Contract Formation

No contract is formed until the Seller has issued a written order confirmation or invoice to the Buyer. Verbal agreements are not binding on the Seller. Quotations are valid for 7 days from the date of issue and may be withdrawn at any time prior to order confirmation. The Seller reserves the right to decline any order at its sole discretion. By placing an order, the Buyer confirms they have read and accepted these terms in full prior to purchase.

2.3 Payment Terms

All goods must be paid for in full prior to dispatch unless otherwise agreed in writing. Where credit terms have been agreed in writing, payment is due within the period stated on the invoice. Late payment is subject to statutory interest at 8% above the Bank of England base rate per annum under the Late Payment of Commercial Debts (Interest) Act 1998, accruing daily from the due date. The Seller reserves the right to recover reasonable debt recovery costs in addition to interest on overdue accounts. Title to goods does not pass to the Buyer until payment in full has been received. The Seller reserves the right to repossess unpaid goods. The Buyer has no right to withhold, set off, or deduct any amount from sums due to the Seller without written consent.

2.4 Delivery, Risk, and Inspection

Risk in goods passes to the Buyer upon delivery to the delivery address specified on the order. The Buyer must inspect all goods immediately upon delivery. Any visible transit damage, shortages, or discrepancies must be noted on the delivery documentation at the time of delivery and reported to the Seller in writing within 48 hours of receipt with photographic evidence. Failure to report damage within 48 hours constitutes acceptance of goods in satisfactory condition. No claims for transit damage, shortage, or visible defect will be accepted outside this window and no credit, replacement, or refund will be issued. Delivery timescales are estimates only and do not form part of the contract. The Seller accepts no liability for late delivery or consequential losses arising from delayed delivery. The Buyer is responsible for ensuring adequate access, unloading facilities, and ground conditions for delivery of heavy generator equipment. Any costs arising from failed or delayed delivery due to inadequate access are the Buyer's sole responsibility. Where goods are collected by the Buyer or a third party on the Buyer's behalf, risk passes upon loading.

2.5 Warranty — All Products

All products are sold with a 12-month parts-only warranty (labour costs excluded in all circumstances), commencing from the date of delivery or first commissioning, whichever is the earlier date, and subject in the case of generator products to a maximum of 1,000 operating hours. The warranty covers manufacturing defects only and is subject to the following conditions and exclusions:

Warranty is valid only where:

The product has been installed by a suitably qualified and competent person in full compliance with BS 7671 and all applicable regulations. The full manufacturer's maintenance schedule has been followed without exception, including all specified oil changes, filter replacements, coolant checks, and scheduled service intervals. Only correct, approved fuel, oil, coolant, and consumables have been used as specified in the operator manual. The product has been operated within its rated electrical and environmental parameters at all times. The Buyer has retained evidence of installation compliance and maintenance records, which must be provided to the Seller upon any warranty claim. The warranty claim is submitted in writing with supporting evidence within the warranty period.

Warranty is void and no claim will be entertained where:

The product has been installed, modified, repaired, or serviced by an unqualified person. Non-approved, incorrect, or counterfeit parts, consumables, or accessories have been used. The maintenance schedule has not been followed or cannot be evidenced. The product has been overloaded, operated outside rated parameters, or subjected to abnormal operating conditions. The product has been operated without adequate ventilation, cooling, or correct earthing. Incorrect fuel has been used, or fuel has been contaminated by water, debris, or incorrect additives. The product has been damaged by misuse, accident, neglect, flooding, fire, or any external cause. Any unauthorised modification, adjustment, or tampering has been carried out. Serial numbers, rating plates, or manufacturer markings have been removed, altered, or obscured. The product has been used for any purpose other than that for which it was designed and sold. The Buyer has failed to report a defect promptly upon discovery — continued operation of a defective unit voids the warranty.

Warranty Claims Process:

Warranty claims must be submitted in writing to info@affordablegenerators.co.uk with a description of the defect, photographic evidence, proof of purchase, evidence of qualified installation, and maintenance records. The Seller reserves the right to inspect the product before approving any warranty claim. Approved warranty claims will be fulfilled by supply of replacement parts only. The Seller does not provide on-site labour, installation, or removal services under warranty. The Buyer is responsible for all labour costs associated with warranty part replacement.

Product-Specific Warranty Notes:

ATS units and changeover switches carry a 12-month parts warranty subject to correct installation and operation within rated parameters. Isolation transformers carry a 12-month parts warranty subject to correct specification, correct installation, and operation within rated load, voltage, and temperature parameters. Warranty on consumable items including but not limited to batteries, filters, belts, and fuses is excluded.

2.6 Servicing and Maintenance

The Buyer is solely and exclusively responsible for all servicing, maintenance, and upkeep of all products purchased from Tracksonhire Ltd. All servicing must be carried out by a suitably qualified and competent person in accordance with the manufacturer's maintenance schedule and operator manual. Failure to service the product at the required intervals, or failure to retain evidence of servicing, will void the warranty.

The Buyer is responsible for the following maintenance at the intervals specified in the operator manual:

Engine oil and oil filter changes at the intervals specified (typically every 250 hours or 12 months, whichever is sooner). Fuel filter replacement. Air filter inspection, cleaning, and replacement. Coolant level checks and coolant replacement at the specified intervals. Battery condition checks, terminal cleaning, and replacement where required. Drive belt inspection and replacement. Alternator and electrical connection inspection. Exhaust system inspection for leaks, corrosion, and damage. Fuel system inspection including fuel lines, injectors, and tank condition. Valve clearance checks and adjustment where specified. All other maintenance items specified in the operator manual.

The Buyer must use only approved fuel, oil, coolant, filters, and consumables as specified in the operator manual. Use of non-approved consumables voids the warranty and may cause damage for which the Seller accepts no liability.

The Buyer must maintain a written service log recording all maintenance carried out, including date, operating hours, work performed, parts used, and the name and qualifications of the person carrying out the work. This log must be made available to the Seller upon request in connection with any warranty claim.

Tracksonhire Ltd does not provide servicing, maintenance, or ongoing support services. The Buyer is responsible for sourcing their own qualified service provider. Tracksonhire Ltd accepts no liability for any loss or damage arising from inadequate, incorrect, or missed maintenance.

2.7 Returns and Cancellations

No returns will be accepted without prior written authorisation from the Seller. Unauthorised returns will be refused and returned to the Buyer at the Buyer's cost. Bespoke, special order, or modified goods are non-returnable under any circumstances. Where a return is authorised, goods must be returned in their original, unused, and undamaged condition in original packaging. Goods that have been installed, fuelled, run, or damaged in any way are not eligible for return. Authorised returns are subject to a restocking charge of up to 25% of the invoice value to cover administration, inspection, and repackaging costs. Return freight costs are the Buyer's sole responsibility. Cancellations of confirmed orders are subject to a cancellation charge reflecting costs already incurred by the Seller including freight, handling, and import costs.

2.8 Limitation of Liability

To the maximum extent permitted by applicable law, Tracksonhire Ltd's total aggregate liability to the Buyer in connection with any product or order, whether arising in contract, tort (including negligence), breach of statutory duty, misrepresentation, or otherwise, is limited solely and exclusively to the original net purchase price paid by the Buyer for the specific product giving rise to the claim.

Tracksonhire Ltd accepts no liability of any kind for any indirect, consequential, special, incidental, exemplary, or punitive loss or damage, including but not limited to: loss of profit, revenue, income, or anticipated savings; loss of business, loss of contract, or loss of opportunity; business interruption of any kind or duration; damage to connected equipment, appliances, machinery, electronics, or plant; data loss or corruption; fire, explosion, or combustion damage; flooding or water damage caused directly or indirectly by the product; structural damage to buildings, premises, or infrastructure; property damage of any nature or value; personal injury or death except where caused by the Seller's own proven negligence; third-party claims, costs, or proceedings of any nature; regulatory fines, enforcement action, penalty notices, or legal proceedings; grid back-feeding incidents, damage to the distribution network, or third-party utility claims; voltage irregularities, frequency instability, power quality issues, or harmonic distortion; phase imbalance or unbalanced loading on three-phase installations; losses arising from incorrect product specification, sizing, or application assessment by the Buyer; losses arising from delayed delivery, product unavailability, or supply chain disruption; losses arising from installation error, commissioning error, or operational error by the Buyer or their agents; any loss arising from failure to follow the operator manual, maintenance schedule, or safety instructions.

This limitation of liability applies regardless of whether Tracksonhire Ltd was advised of the possibility of such losses prior to their occurrence, and regardless of the cause of the loss, including product failure, specification error, installation error, operational error, or any combination thereof. The Buyer acknowledges that this limitation is reasonable given the nature of the products, the Buyer's obligation to carry out adequate pre-purchase assessment, and the availability of appropriate insurance to the Buyer.

Nothing in these terms limits or excludes liability for: (a) death or personal injury caused by Tracksonhire Ltd's own proven negligence; (b) fraudulent misrepresentation; (c) any other liability that cannot be excluded or limited under English law.


SECTION 3 — BUYER RESPONSIBILITIES (ALL PRODUCTS)

3.1 All Products — General Obligations

Read, understand, and comply with all safety warnings, operator manuals, and maintenance schedules prior to installation and operation. Ensure all installation, commissioning, maintenance, and repair is carried out by suitably qualified and competent persons. Inspect all goods on delivery and report damage in writing within 48 hours. Operate all products within rated electrical, thermal, and environmental parameters. Maintain all products in accordance with the manufacturer's maintenance schedule and retain records of all maintenance carried out. Source replacement parts and consumables from approved suppliers only and ensure compatibility before fitting. Comply with all applicable UK legislation, regulations, British Standards, and local authority requirements relating to installation, operation, noise, emissions, planning, fire safety, and environmental protection. Obtain all necessary planning permissions, building regulations approvals, environmental permits, site authorisations, and any other approvals required before installation or operation. Arrange and maintain adequate product liability, public liability, property, and business interruption insurance appropriate for the products in use. Notify Affordable Generators promptly in writing upon discovery of any defect, fault, or safety concern with any product. Specify, source, and arrange installation of all necessary safety features and protective devices — including circuit breakers, RCDs, GFCIs, surge protectors, and phase conversion equipment — before energising any product. These devices are not supplied as standard and their selection and installation is the buyer's sole responsibility.

3.2 Diesel Generators — Single Phase and Three Phase

Correct fuel selection and compliance with all fuel duty and red diesel regulations — red diesel is illegal on construction sites since April 2022. Correct load calculation and generator sizing for the intended application, accounting for starting surges, power factor, and duty cycle. Phase balancing across all three phases on three-phase installations — unbalanced loading is the Buyer's sole responsibility. Correct earthing arrangements assessed and installed by a qualified electrician in accordance with BS 7671. Connection to mains supply via certified ATS or manual changeover switch only — no exceptions. Adequate permanent ventilation and safe exhaust gas dispersal away from all occupied areas. Compliance with noise regulations including Environmental Protection Act 1990, local authority requirements, and any planning conditions. Fuel storage in compliance with DSEAR 2002 and Petroleum (Consolidation) Regulations 2014. Diesel storage and spill management in compliance with Environment Agency guidelines and water protection regulations. Regular maintenance including oil and filter changes, coolant checks, battery maintenance, and air filter servicing at intervals specified in the operator manual. Compliance with fire safety requirements including safe siting clearances and provision of appropriate fire suppression. Structural assessment of installation surface, floor, or platform to confirm adequacy for the unit's operational weight. Correct interpretation and use of prime power vs standby power ratings — the Buyer is responsible for selecting the appropriate rating for their application. Where a three-phase generator is to be used in a single-phase application, the Buyer is solely responsible for sourcing and installing appropriate phase conversion equipment, single-phase protection devices, and all associated safety equipment. This work must be carried out by a qualified electrician before the generator is operated.

3.3 Automatic Transfer Switches (ATS) and Manual Changeover Switches

Correct selection and rating of the ATS or changeover switch for the specific generator output, mains supply rating, and load current. Confirmation of voltage, frequency, and phase compatibility between the ATS unit and both the generator and mains supply before installation. Installation exclusively by a qualified electrician in accordance with BS 7671 and the manufacturer's wiring diagram. Correct cable sizing, protection coordination, and fault level assessment for the installation. Testing and commissioning of automatic changeover functionality before relying on the system for standby operation. Periodic testing, inspection, and maintenance of ATS and changeover equipment throughout its service life. Compliance with all applicable electrical safety regulations and British Standards. Ensuring that under no circumstances can the generator output and mains supply be connected simultaneously — the Buyer's electrician is responsible for verifying this before energising.

3.4 Isolation Transformers

Correct specification of input voltage, output voltage, kVA rating, frequency, insulation class, IP rating, and winding configuration (e.g. 1:1, step-up, step-down, centre-tapped) prior to purchase. Specification is the Buyer's sole responsibility. Installation by a qualified electrician only, in accordance with BS 7671 and all applicable electrical safety standards. Confirmation of load compatibility and that connected load does not exceed the transformer's rated kVA output at the specified power factor. Understanding that isolation transformers reduce but do not eliminate all electrical hazard — the secondary circuit remains live and dangerous and must be treated accordingly. PAT testing, periodic inspection, and maintenance of isolation transformers in accordance with IET Code of Practice for In-Service Inspection and Testing of Electrical Equipment. Correct thermal management — isolation transformers must not be enclosed in spaces without adequate ventilation, as overheating can cause insulation failure and fire. Compliance with all applicable British Standards, electrical safety regulations, and workplace safety legislation.

3.5 Product Specification and Suitability

Tracksonhire Ltd provides product specifications in good faith based on information supplied by manufacturers. Specifications are subject to change without notice and minor variations may occur between production batches. The Buyer is solely and exclusively responsible for confirming that any product is suitable for their specific application, site conditions, load profile, regulatory environment, and operational requirements before placing an order. Tracksonhire Ltd accepts no liability for loss or damage arising from product unsuitability where the Buyer has failed to carry out adequate pre-purchase assessment and specification verification. Engine and alternator brands specified on product listings refer to the brand of equipment fitted to the generator at the time of manufacture. The Buyer is responsible for confirming exact engine model, alternator brand, and parts availability for their requirements before purchase. Tracksonhire Ltd makes no representation regarding the interchangeability of parts between different engine brands or models.


SECTION 4 — GENERAL PROVISIONS

4.1 Governing Law and Jurisdiction

These terms and any dispute or claim arising out of or in connection with them or their subject matter or formation (including non-contractual disputes or claims) shall be governed by and construed in accordance with the law of England and Wales. The parties irrevocably agree that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these terms.

4.2 Statutory Rights

Nothing in these terms is intended to limit or exclude any liability or right that cannot be excluded or restricted under applicable English law. Where the Buyer is a consumer (purchasing outside the course of a business), their statutory rights under the Consumer Rights Act 2015 are not affected. These terms are intended for business-to-business transactions only.

4.3 Severability and Waiver

If any provision of these terms is found to be invalid, unlawful, or unenforceable by any court of competent jurisdiction, that provision shall be deemed severed from the remaining terms, which shall continue in full force and effect. No failure or delay by the Seller in exercising any right or remedy shall constitute a waiver of that right or remedy.

4.4 Force Majeure

Tracksonhire Ltd shall not be liable for any failure or delay in performing its obligations caused by circumstances beyond its reasonable control, including but not limited to acts of God, war, civil unrest, pandemic, strikes, port closures, shipping delays, supply chain disruption, government action, or import/export restrictions. In such circumstances the Seller reserves the right to delay, partially fulfil, or cancel any order without liability.

4.5 Full Terms and Conditions

These safety warnings and terms of sale form part of Tracksonhire Ltd's full Terms and Conditions of Sale. In the event of any conflict between this document and supplementary terms published elsewhere, this document shall prevail. The Buyer is responsible for reading these terms in full prior to placing any order.
