By purchasing a diesel generator from Tracksonhire Ltd (referred to as "the Seller"), you acknowledge and agree to the following terms:
Exclusion of Liability for Personal Injury or Death: The Seller shall not be held liable for any personal injury, including fatal accidents, arising from the use or operation of the diesel generators.
Assumption of Risk: The Buyer acknowledges and agrees that they assume all risks associated with the use of the generators purchased from the Seller.
Indemnification: The Buyer agrees to indemnify and hold harmless the Seller against any claims, losses, damages, or expenses, including legal fees, arising from personal injury or death resulting from the Buyer's use or operation of the generators.
Limitation of Liability: In no event shall Tracksonhire Ltd, its directors, officers, employees, affiliates, agents, contractors, or suppliers be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to lost profits, loss of revenue, loss of data, or loss of use, arising out of or in connection with the purchase, use, or operation of the diesel generators.
Maximum Liability: Notwithstanding any other provision of this agreement, the maximum liability of Tracksonhire Ltd, its directors, officers, employees, affiliates, agents, contractors, or suppliers, arising out of or in connection with the purchase, use, or operation of the diesel generators, shall not exceed the purchase price paid by the Buyer for the generators.
Governing Law: This agreement shall be governed by and construed in accordance with the laws of England and Wales.
By completing the purchase of a diesel generator from Tracksonhire Ltd, you confirm that you have read, understood, and agreed to the terms of this liability and indemnification clause.
